Terms of Service

These Terms of Service (“Terms”) govern your use of CinemaScape AI (the “Service”), provided by DeltaPrompt AI(“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. You represent that you have the legal authority to agree to these Terms.

2. Your account

  • Provide accurate information when creating your account, and keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • Notify us immediately of any unauthorized use.
  • One account per individual.

3. Your content

“Your Content” means anything you create, write, upload, or otherwise submit to the Service — including projects, scenes, screenplays, summaries, loglines, characters, locations, and reference images.

You retain all ownership rights in Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and modify Your Content solely as necessary to provide the Service to you — including transmitting Your Content to AI providers (Anthropic and OpenAI) when you trigger an AI action. This license terminates when Your Content is deleted, except as retained for backup or as required by law.

You represent and warrant that you have all rights necessary to upload Your Content and to grant the license above, and that Your Content does not infringe any third-party rights.

4. AI-generated content

The Service generates suggestions, expansions, storyboards, shot lists, and other outputs (“AI Output”) using third-party AI providers. By using AI features:

  • Your inputs and metadata are sent to the selected AI provider (Anthropic or OpenAI) for processing.
  • As between you and us, you may use AI Output for any lawful purpose, including commercial use, subject to the third-party providers' terms.
  • AI Output is generated probabilistically. We do not guarantee that any AI Output is accurate, original, non-infringing, or suitable for your intended use. You are responsible for reviewing AI Output before relying on or publishing it.
  • The same or similar AI Output may be generated for other users. We make no claim of exclusivity over AI Output.
  • You will not use AI features to generate content that is illegal, infringing, harassing, defamatory, sexually explicit involving minors, or otherwise prohibited by Section 5.

5. Acceptable use

You will not, and will not permit anyone else to:

  • Violate any law, regulation, or third-party rights.
  • Upload or generate child sexual abuse material (CSAM), or any content that sexualizes minors.
  • Generate or distribute content that incites violence or hatred, or targets, harasses, threatens, or defames any person or group.
  • Generate deceptive content intended to defraud, impersonate without authorization, or interfere with elections.
  • Upload reference images of identifiable people without their consent, or images you do not own or have license to use.
  • Reverse engineer, decompile, or attempt to extract source code or model weights from the Service.
  • Scrape, mass-download, or otherwise access the Service via automated means in a way that bypasses rate limits or imposes a disproportionate load on infrastructure.
  • Upload viruses, malware, or other harmful code; transmit spam or unsolicited messages.
  • Resell or sublicense access to the Service without our consent.

We may suspend or terminate your account at any time, without prior notice, if we reasonably believe you have violated these Terms.

6. Public submissions and the gallery

Marking a project as Public or submitting it to the public gallery makes the published content visible to other users. Other users may contact you, but the Service does not create any agency, employment, production, agency-representation, or commercial relationship between you and any viewer or director. Any agreements you enter with third parties through the Service are solely between you and them; we are not a party.

7. Fees and usage limits

Access to the Service may be free, free with usage limits, or paid. Where AI usage limits or budgets apply, we will surface them in the product. We may change, add, or remove paid tiers and usage caps at any time; material changes will be communicated in advance where practical.

8. Third-party services

The Service relies on third-party providers including Supabase, Vercel, Anthropic, and OpenAI. Your use of AI features is also subject to the applicable provider's terms. We are not responsible for the availability, accuracy, or content of third-party services, but we will use commercially reasonable efforts to maintain the Service.

9. Intellectual property

Except for Your Content, all rights in the Service — including the software, design, brand marks (“CinemaScape AI,” the CinemaScape AI logo, “DeltaPrompt AI”), and the content we publish — are owned by us or our licensors. You may not copy, modify, or create derivative works based on these elements without permission.

10. Copyright and DMCA-style takedown

If you believe content on the Service infringes your copyright, send a notice to legal@deltaprompt.ai including: (a) identification of the copyrighted work; (b) the infringing content and its location on the Service; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or are authorized to act on their behalf; and (f) your physical or electronic signature.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI OUTPUT MAY CONTAIN INACCURACIES OR REFLECT BIASES OF UNDERLYING MODELS. DO NOT RELY ON AI OUTPUT FOR LEGAL, MEDICAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

13. Indemnification

You will indemnify and hold harmless DeltaPrompt AI, its officers, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

14. Governing law

These Terms are governed by the laws of [INSERT JURISDICTION — to be set by DeltaPrompt AI], without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction and venue of the courts located in that jurisdiction for any dispute not subject to arbitration.

15. Termination

You may stop using the Service and delete your account at any time from the Profile page. We may suspend or terminate your access for any reason, including violation of these Terms. Upon termination, the license you granted to your Content ends, except as needed to comply with legal obligations and to complete pending tasks like AI cost accounting.

16. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

17. Entire agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and DeltaPrompt AI regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect.
