Terms of Service

These Terms of Service (“Terms”) govern your use of CinemaScape AI (the “Service”), provided by DeltaPrompt AIof Windsor, Ontario, Canada (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. You represent that you have the legal authority to agree to these Terms.

The Service is not offered in mainland China, Hong Kong or Macau. You may not access or use it from those places, including through a VPN, proxy or other way of hiding your location, and we may suspend or close accounts that do.

2. Your account

  • Provide accurate information when creating your account, and keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • Notify us immediately of any unauthorized use.
  • One account per individual.

3. Your content

“Your Content” means anything you create, write, upload, or otherwise submit to the Service — including projects, scenes, screenplays, summaries, loglines, characters, locations, and reference images.

You retain all ownership rights in Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and modify Your Content solely as necessary to provide the Service to you — including transmitting Your Content to our AI providers (listed in the Privacy Policy) when you trigger an AI action. This license terminates when Your Content is deleted, except as retained for backup or as required by law.

You represent and warrant that you have all rights necessary to upload Your Content and to grant the license above, and that Your Content does not infringe any third-party rights.

4. AI-generated content

The Service generates suggestions, expansions, storyboards, shot lists, and other outputs (“AI Output”) using third-party AI providers. By using AI features:

  • Your inputs and metadata are sent to the AI provider that powers the feature — for example Anthropic, OpenAI, or, through fal.ai, Google, ElevenLabs and MiniMax — for processing.
  • As between you and us, you may use AI Output for any lawful purpose, including commercial use, subject to the third-party providers' terms.
  • AI Output is generated probabilistically. We do not guarantee that any AI Output is accurate, original, non-infringing, or suitable for your intended use. You are responsible for reviewing AI Output before relying on or publishing it.
  • The same or similar AI Output may be generated for other users. We make no claim of exclusivity over AI Output.
  • You will not use AI features to generate content that is illegal, infringing, harassing, defamatory, sexually explicit involving minors, or otherwise prohibited by Section 5.

4.1 Real people, voices, and brands

The Service can produce realistic images, video, and voices. You are solely responsible for what you create and publish with it. You will not use the Service to:

  • depict a real, identifiable person — including celebrities, politicians, athletes, and other public figures — or imitate their voice, without that person's permission, in a way that could reasonably be taken as real or as their endorsement;
  • create sexual, intimate, degrading, or humiliating content of any real person, under any circumstances;
  • create realistic depictions of events that did not happen and present them as real — including fake news, fake evidence, fake documents, or content meant to mislead voters;
  • use another company's name, logo, trademarks, products, or packaging (including in a brand kit) unless you own them or are authorized by the owner.

When you upload a photo of a person, a logo, or product images, you confirm that you have the rights and permissions needed for that use. Our AI providers may refuse some requests involving real people; that does not shift responsibility for your content to us.

4.2 AI labels

Videos and images made with the Service are AI-generated. We mark rendered videos as AI-generated, with a visible label (for example, on the end card or in a corner) and with embedded metadata. You will not remove, obscure, or alter these labels where the law of the place you publish requires AI content to be labelled (including India's IT Rules and the EU AI Act), and you will follow the AI-disclosure rules of each platform you post to.

5. Acceptable use

You will not, and will not permit anyone else to:

  • Violate any law, regulation, or third-party rights.
  • Upload or generate child sexual abuse material (CSAM), or any content that sexualizes minors.
  • Generate or distribute content that incites violence or hatred, or targets, harasses, threatens, or defames any person or group.
  • Generate deceptive content intended to defraud, impersonate without authorization, or interfere with elections.
  • Upload reference images of identifiable people without their consent, or images you do not own or have license to use.
  • Reverse engineer, decompile, or attempt to extract source code or model weights from the Service.
  • Scrape, mass-download, or otherwise access the Service via automated means in a way that bypasses rate limits or imposes a disproportionate load on infrastructure.
  • Upload viruses, malware, or other harmful code; transmit spam or unsolicited messages.
  • Resell or sublicense access to the Service without our consent.

We may suspend or terminate your account at any time, without prior notice, if we reasonably believe you have violated these Terms.

6. Public submissions and the gallery

Marking a project as Public or submitting it to the public gallery makes the published content visible to other users. Other users may contact you, but the Service does not create any agency, employment, production, agency-representation, or commercial relationship between you and any viewer or director. Any agreements you enter with third parties through the Service are solely between you and them; we are not a party.

7. Fees, subscriptions, and AI credits

Access to the Service may be free, free with usage limits, or paid. Paid subscriptions are billed in advance on a recurring monthly basis through our payment processor (Stripe) and renew automatically until cancelled. You can cancel at any time through the billing portal; cancellation takes effect at the end of the current billing cycle, and fees already paid are non-refundable except where required by law.

AI credits.AI-powered features (including storyboard generation and AI writing tools) consume “credits” — a virtual, in-app unit of measure that we define and administer. Credits are licensed to you for use within the Service. Credits:

  • have no cash or monetary value, are not a currency, deposit, or stored-value instrument, and cannot be redeemed, exchanged, transferred, or sold;
  • are consumed at rates we determine, which reflect the underlying cost of third-party AI processing plus a service margin, and may change at any time (including in response to third-party AI provider price changes);
  • included with a subscription (“monthly credits”) reset at each billing cycle and do not roll over;
  • purchased separately or granted promotionally (“top-up credits”) carry over between cycles but expire when your account is closed and are non-refundable except where required by law;
  • displayed consumption estimates (e.g. “a storyboard costs about 20 credits”) are approximations — actual deductions are based on measured processing and may vary with content length and complexity.

When your credits are exhausted, AI generation pauses until your monthly credits reset or you purchase additional credits; your projects and existing content remain accessible. Free-tier allowances (such as one-time welcome credits and free storyboard generations) are one-per-account, may not be farmed through multiple accounts, and may be modified or withdrawn at any time. We may change, add, or remove plans, prices, credit allowances, and consumption rates at any time; material changes will be communicated in advance where practical and will not retroactively reduce credits you have already purchased.

Price changes for subscriptions. If we increase the price of a paid subscription, we will tell you by email or in the Service at least 30 days before the new price applies to your subscription. The increase takes effect from your next billing cycle after that notice period, and you may cancel before then to avoid it. Prices may be shown and charged in your local currency (for example, in Indian rupees for customers in India); taxes may apply where required by law.

Promotional pricing.From time to time we may offer promotional prices, such as our launch “Premiere Offer”. Unless the offer says otherwise, a subscription started at a promotional price during the offer period keeps that price for 12 months from its start date, provided it stays active (a cancelled subscription that is later restarted is charged the price current at that time). After the 12 months, the then-current price applies, with notice as described above. The offer period and its end date are shown on our pricing page.

8. Third-party services

The Service relies on third-party providers including Supabase, Vercel, Anthropic, and OpenAI. Your use of AI features is also subject to the applicable provider's terms. We are not responsible for the availability, accuracy, or content of third-party services, but we will use commercially reasonable efforts to maintain the Service.

YouTube. If you connect a YouTube account and post videos through the Service, you are agreeing to be bound by the YouTube Terms of Service, and Google's use of your data is governed by the Google Privacy Policy. You are responsible for the videos you choose to post and for complying with YouTube's Community Guidelines.

9. Intellectual property

Except for Your Content, all rights in the Service — including the software, design, brand marks (“CinemaScape AI,” the CinemaScape AI logo, “DeltaPrompt AI”), and the content we publish — are owned by us or our licensors. You may not copy, modify, or create derivative works based on these elements without permission.

10. Complaints and takedown (copyright, likeness, and more)

If you believe content made with the Service uses your likeness or voice without permission, is a deceptive deepfake, or otherwise violates your rights or these Terms, email legal@deltaprompt.ai with a description and where the content appears. We acknowledge complaints within 24 hours and aim to resolve them within 7 days; we may remove content and suspend accounts that violate these Terms.

If you believe content on the Service infringes your copyright, send a notice to legal@deltaprompt.ai including: (a) identification of the copyrighted work; (b) the infringing content and its location on the Service; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or are authorized to act on their behalf; and (f) your physical or electronic signature.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI OUTPUT MAY CONTAIN INACCURACIES OR REFLECT BIASES OF UNDERLYING MODELS. DO NOT RELY ON AI OUTPUT FOR LEGAL, MEDICAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

13. Indemnification

You will indemnify and hold harmless DeltaPrompt AI, its officers, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content, including anything you create, publish, or share using the Service; (b) your violation of these Terms; or (c) your violation of any law or third-party right — including claims of defamation, invasion of privacy, misuse of a person's name, likeness, or voice (right of publicity or personality rights), and trademark or copyright infringement.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of Ontario, Canada have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where the law of your place of residence gives you a mandatory right to bring a claim where you live. Nothing in these Terms limits consumer protections that cannot be waived by contract.

15. Termination

You may stop using the Service and delete your account at any time from the Profile page. We may suspend or terminate your access for any reason, including violation of these Terms. Upon termination, the license you granted to your Content ends, except as needed to comply with legal obligations and to complete pending tasks like AI cost accounting.

16. Changes

We may update these Terms from time to time. When we make material changes, we will ask you to review and accept the updated Terms in the Service before you continue using it; if you do not accept them, you may stop using the Service and delete your account. Minor changes (such as clarifications or contact details) take effect when posted.

17. Entire agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and DeltaPrompt AI regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect.
